Employees use ChatGPT and similar tools for drafting texts, translations, research, analysis or as a support for their day-to-day work. However, as its use increases, a legal question also arises:&nbsp;<strong>What skills do employees need when working with AI?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since 2 February 2025, the EU AI Act has required companies to take measures to&nbsp;<strong>Development of AI expertise<\/strong>&nbsp;to be implemented. The regulation applies to providers and operators of AI systems and was amended again in 2026.&nbsp;<\/p>\n\n\n\n<h2 class=\"gb-text\"><strong>What does \u2018AI competence\u2019 mean under the EU AI Act?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 4 of the AI Act does not require standardised compulsory training for all employees. Instead, organisations should take measures tailored to the specific use of AI and the individuals concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among other things, this should involve&nbsp;<strong>technical knowledge, experience, training and the specific context of use<\/strong>be taken into account. What matters, therefore, is not that every employee understands the technical details of AI. Rather, they must be able to use the AI systems they work with appropriately and in an informed manner.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, following the amendment introduced by the Digital Omnibus, it has been explicitly clarified that companies&nbsp;<strong>do not have to guarantee a specific level of competence for individual people<\/strong>.&nbsp;<\/p>\n\n\n\n<h3 class=\"gb-text\"><strong>Not every employee needs the same training<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The knowledge required depends very much on the job.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone who uses AI simply to draft emails or marketing copy requires different skills to an employee who uses AI to analyse personal data or to support business-critical decisions.<\/p>\n\n\n\n<h2 class=\"gb-text\"><strong>What topics should an AI training course cover?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The AI Act does not prescribe any specific training format. According to the European Commission\u2019s current recommendations, organisations should first clarify,&nbsp;<strong>which AI systems are used, what risks are associated with them, and what knowledge the respective users need<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, the following topics in particular may be relevant:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>How AI systems work and their limitations<\/strong><\/li>\n\n\n\n<li><strong>Hallucinations and incorrect results<\/strong><\/li>\n\n\n\n<li><strong>Data protection and confidential business information<\/strong><\/li>\n\n\n\n<li><strong>Copyright and the use of third-party content<\/strong><\/li>\n\n\n\n<li><strong>human oversight and review of AI outputs<\/strong><\/li>\n\n\n\n<li><strong>Permitted and prohibited areas of use within the company<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Particularly when it comes to generative AI, it is therefore not enough simply to provide staff with a tool. They also need to know,&nbsp;<strong>when they need to scrutinise his findings critically<\/strong>.<\/p>\n\n\n\n<h2 class=\"gb-text\"><strong>How can companies organise AI expertise in a way that complies with the law?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A sensible first step is to take stock of the situation:&nbsp;<strong>Which AI tools are already in use, and which staff members are using them?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Building on this, organisations can develop a range of training and information formats. For example, a general induction course can be supplemented by specific guidelines for individual departments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, Article 4 does not require companies to appoint a dedicated \u201eAI officer\u201c or set up a special AI committee. Nor is a specific certificate required. Companies may, however, keep internal records of training and other measures.&nbsp;<\/p>\n\n\n\n<h3 class=\"gb-text\"><strong>Thinking about AI policy and training as a whole<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An internal&nbsp;<strong>AI Policy<\/strong>&nbsp;can specify which tools may be used, which data must not be entered, and when results must be checked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The AI policy should not be viewed in isolation. It is only through the interplay of&nbsp;<strong>clear rules, practical training and documented procedures<\/strong>&nbsp;provides a clear organisational framework.<\/p>\n\n\n\n<h2 class=\"gb-text\"><strong>What businesses should bear in mind at this time<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The requirement for AI literacy is not a call to train every employee to become an AI expert. Rather, it calls for a&nbsp;<strong>a risk-based approach to AI that is tailored to the specific application<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Companies should therefore assess which AI systems are already in use, which staff members are working with them, and what risks this entails. Training programmes, internal guidelines and documentation can then be tailored specifically to address these issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Our practical tip:<\/strong>&nbsp;Don\u2019t wait for a formal review. Organisations should now take stock of their existing use of AI and document, in a transparent manner, which measures to build AI competence have already been implemented. This is because the monitoring and enforcement of Article 4 has now begun.&nbsp;<\/p>\n\n\n\n<h2 class=\"gb-text\">Conclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">AI expertise is now part of the&nbsp;<strong>AI compliance in organisations<\/strong>.
